Terms and Conditions of Rental

1. Agreement Overview
This Rental Agreement ("DISCOUNTSTORE365.CA") is a legally binding contract between [DISCOUNTSTORE365.CA] ("Owner," "We," "Us") and the individual or entity renting the equipment ("Renter," "You," "Your"). By signing this Agreement, You agree to all terms and conditions outlined herein for the rental of the mobility scooter or power wheelchair ("Equipment").
2. Eligibility and Requirements
To rent from us, You must:
· Be at least 18 years of age.
· Provide a valid government-issued photo ID (e.g., driver's license, passport).
· Provide a valid credit card for the security deposit and all charges.
· Demonstrate the physical and cognitive ability to safely operate the Equipment, or have a responsible attendant who can do so on Your behalf.
3. Rental Period and Fees
· Rental Period: The rental period begins and ends on the dates and times specified in this Agreement. The Equipment must be returned by the agreed-upon date and time.
· Extension: If You wish to extend the rental, You must contact us before the scheduled return time for approval. Extensions are subject to Equipment availability and will be charged at the prevailing daily rate.
· Fees: You agree to pay the following:
· The base rental fee.
· Any applicable taxes and surcharges.
· A refundable security deposit (see Section 8).
· Late return fees (see Section 4).
· Charges for damage, loss, or excessive cleaning (see Section 7).
4. Late Returns
Equipment returned after the scheduled date and time will incur late fees. The late fee is [e.g., one full day's rental rate for every 24-hour period, or a specific dollar amount per hour] that the Equipment is overdue.
5. Use of Equipment
· Safe Operation: You agree to operate the Equipment in a safe and responsible manner at all times.
· Intended Use: The Equipment is designed for use on paved or hard-packed surfaces. It is not intended for use on public roads, highways, beaches, steep inclines, off-road terrain, or in wet conditions unless specifically stated.
· Prohibited Actions: You agree NOT to:
· Operate the Equipment under the influence of alcohol or drugs.
· Use the Equipment to carry passengers (unless it is a specifically designed two-person model).
· Exceed the maximum weight capacity as stated in the user manual.
· Tamper with, modify, or attempt to repair the Equipment.
· Use the Equipment for illegal purposes or in a reckless manner.
· Remove the Equipment from the designated [e.g., city, resort, area] without prior written permission.
6. Delivery, Pick-up, and Return
· Delivery & Pick-up: If delivery and pick-up services are offered, You are responsible for being present at the agreed-upon time and location. Failure to be present may result in additional fees.
· Return: The Equipment must be returned in the same condition as when it was rented, subject to normal wear and tear. The battery must be charged upon return. A fee may be applied for a returned Equipment with a dead battery.
7. Damage, Loss, and Theft
· Responsibility: You are financially responsible for any loss, theft, or damage to the Equipment and its components (including keys, chargers, and baskets) during the rental period, regardless of fault or cause, except for normal wear and tear.
· Damage/Loss Fee: In the event of damage or loss, You will be charged for the full cost of repair or replacement, plus any loss of rental income.
· Theft: You must report the theft of the Equipment to the local police and to us immediately. You are responsible for the full replacement cost of the Equipment if it is stolen.
8. Security Deposit
A pre-authorization or charge will be placed on Your credit card for a security deposit at the start of the rental. This deposit is fully refundable provided the Equipment is returned on time, undamaged, with all components, and in a clean condition. We reserve the right to deduct from the deposit for any charges owed under this Agreement.
9. Disclaimer of Warranties & Limitation of Liability
· "As Is" Rental: The Equipment is rented on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, about the Equipment's merchantability or fitness for a particular purpose.
· Assumption of Risk: You acknowledge that operating the Equipment involves inherent risks, including but not limited to falls, collisions, and tip-overs. You voluntarily assume all such risks.
· Limitation of Liability: To the fullest extent permitted by law, Our total liability to You for any claim arising from this Agreement is limited to the total rental fees You have paid. We shall not be liable for any indirect, incidental, special, or consequential damages, including personal injury, property damage, or loss of enjoyment.
10. Indemnification
You agree to indemnify, defend, and hold harmless [Your Company Name], its owners, employees, and agents from and against any and all claims, lawsuits, damages, injuries, losses, and costs (including legal fees) arising from or related to Your use, operation, or possession of the Equipment.
11. Cancellation Policy
· By Renter: Cancellations made [e.g., more than 24 hours in advance] will receive a full refund. Cancellations made within [e.g., 24 hours] of the scheduled rental start time may be subject to a cancellation fee.
· By Owner: We reserve the right to cancel a reservation at any time due to Equipment unavailability, safety concerns, or if You fail to meet the eligibility requirements. In such a case, You will receive a full refund.
12. Governing Law
